In accordance with legal regulations “The Practice of Dr. P. Polyanszky”, as content provider according to §5 Abs.1 of the German State Treaty on Media Services, can only be held responsible for the contents of his own site. This content is to be differentiated from links to other websites. “Links” shall be labeled as such, when they refer to the use of “external content”. “The Practice of Dr. P. Polyanszky” can only be held responsible for this content when he has positive knowledge of its existence (which also includes illegal or criminal content) and it is technically possible and reasonable to impede its usage (§5 Abs.2 German State Treaty on Media Services). The term “Links” refers exclusively to “existent” (dynamic) references. “The Practice of Dr. P. Polyanszky” examined the external content upon construction of the initial shortcut to determine whether a breach of a civil law or criminal law responsibility would occur. However, the content provider is not obliged to continually examine the content he offers in his links for changes that could justify renewed responsibility. If he notes or if a third party points out that the link contains a specific offer which may be against civil or criminal law, the reference to this offer will be checked and removed if necessary, as far as it is technically possible and reasonable. The technical possibility and reasonableness shall not be influenced by the fact that the unlawful or illegal offering can be accessed from other servers even after the prevention of access via the website of the practice of Dr. P. Polyanszky.
